Ein derartig großes Unternehmen mit </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Fachpersonal</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">müsse </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Mahnungen</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">und zugehörige Folgeschreiben selber abfassen können. Dem Unternehmen stehe daher kein Anspruch auf Erstattung der Anwaltskosten zu.</span></span></span><span style="color: #000000;"><span style="font-family: arial, helvetica, sans-serif;"><span style="font-size: small;"> </span></span></span></p>
<p class="western" align="left"><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"><u>Fazit:</u></span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Die Urteile des </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Amtsgerichts Dortmund</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">sowohl zu den Kosten des vormaligen Tochter</span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">inkassounternehmens</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">als auch nun zu den </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Rechtsanwaltskosten</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">überraschen nicht wirklich.</span></span></span></p>
<p class="western" align="left"><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Grundsätzlich hat ein Mieter die vereinbarte Miete gemäß </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">§ 556 b Abs. 1 BGB</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">spätestens bis zum dritten Werktag eines Monats im Voraus zu bezahlen. Kosten eines </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Inkassounternehmens</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">gehören können.</span></span></span></p>
<p class="western" align="left"><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Verzug</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">bedeutet aber nicht, dass der Gläubiger jeden „aberwitzigen“ Schaden verursachen darf und der Schuldner ohne jedes wenn und aber zahlen müsste. Bei den </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Kosten der Rechtsverfolgung</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">ist nach der </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">BGH</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">-Rechtsprechung daher Voraussetzung, dass die anwaltliche Tätigkeit zur Wahrung und Durchsetzung der Rechte des Gläubigers </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">erforderlich</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">und </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">zweckmäßig</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">war ( BGH-Beschluss vom 31.01.2012- </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">VIII ZR 277/11</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">= IMR 2011,7 ).</span></span></span></p>
<p class="western" align="left"><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Vorliegend ist in der Tat nicht einsehbar, warum ein gewerbliches Wohnungsgroßunternehmen mit </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Fachpersonal</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">, welches über Jahre sein </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Mahnwesen</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">selbst betrieben hat und damit wirklich nicht als </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">geschäftlich ungewandt</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">angesehen werden kann, dies plötzlich nicht mehr können soll und kostenträchtige Hilfe Dritter in Anspruch nehmen soll.</span></span></span></p>
