<h3 align="left">Der Fall</h3>
<p class="western" align="left"><span style="color: #333333;"> </span><span style="color: #000000;"> </span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"><u>Der Sachverhalt:</u></span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Der </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Vermieter</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> vermietete seine Wohnung an einen Arbeitslosengeld II -Empfänger, für den das </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Jobcenter</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> im Rahmen der dortigen Leistungen auch die </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Mietkosten</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> übernahm. Der zugehörige </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Leistungsbescheid</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> war natürlich an den Mieter als Leistungsadressaten gerichtet. Im </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Mietvertrag</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> trat der Mieter seine die Miete betreffenden Leistungsansprüche als Sicherheit an den Vermieter ab. Auf Wunsch des </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Mieters</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> zahlte das </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Jobcenter</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> die Miete auch zunächst unmittelbar an den </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Vermieter</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">. Als der </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Mieter</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> dieser </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Direktzahlung</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> später widersprach, wurde die </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Miete </span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">nachfolgend vom Jobcenter an den </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Mieter</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> ausgezahlt, der das Geld jedoch nicht an den </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Vermieter </span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">weiter leitete, so dass es zum Auflauf von </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Mietrückständen</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> kam. Der Vermieter verklagte nun das Jobcenter auf Übernahme der aufgelaufenen </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Mietrückstände</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> und hatte damit beim LSG Bayern keinen Erfolg.</span></span></span></p>
<p class="western" align="left"><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"><u>Das Problem:</u></span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Zwischen dem </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Vermieter</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> und dem</span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> Jobcenter</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> bestehen </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">keine unmittelbaren Rechtsbeziehungen</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">, die Grundlage eines eigenen Zahlungsanspruches des Vermieters gegenüber dem Jobcenter sein könnten.</span></span></span></p>
<p class="western" align="left"><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Durch die früheren Direktzahlungen ist </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">kein unmittelbarer Leistungsanspruch</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> des Vermieters entstanden, insbesondere </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">kein Schuldbeitritt</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> des Jobcenters praktisch als weiterer Mietschuldner neben dem Mieter.</span></span></span></p>
<h3 align="left">Abtretung</h3>
<p class="western" align="left"><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Die </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Abtretung</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> der eigenen Leistungsansprüche des Mieters im Hinblick auf die Mietkosten an den Vermieter, musste sich auch als </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Scheinsicherheit</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> erweisen, da die Mietvertragsparteien übersehen hatten, dass die Leistungsansprüche des Mieters gegenüber dem Jobcenter wegen ihrer geringen Höhe </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">unpfändbar</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> waren. Hier bestimmt aber </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">§ 400</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">BGB</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">, dass unpfändbare Forderungen </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">nicht abgetreten </span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">werden können.</span></span></span></p>
<p class="western" align="left"><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"><u>Begründung eigener Vermieterzahlungsanspruch erforderlich:</u></span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: small;"> </span></span></span><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Dem Vermieter hilft bei solchen Konstellationen lediglich, wenn im Zusammenwirken mit dem potentiellen Mieter und dem Jobcenter ein </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">eigener</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> gegenüber dem Jobcenter </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">einklagbarer Zahlungsanspruch</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> des Vermieters begründet wird. Dies wäre möglich in Form eines </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">eigenen Verwaltungsaktes</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> des Jobcenters, mit dem im wohlverstandenen Interesse des hilfebedürftigen Mieters, entsprechende Zahlungsansprüche begründet werden. Denkbar wäre auch ein entsprechender </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">öffentlich-rechtlicher Vertrag</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;"> zwischen </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Jobcenter </span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">und </span></span></span><strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Vermieter</span></span></span></strong><span style="color: #000000;"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">.</span></span></span></p>
<p class="western" align="left"><span style="font-family: 'Times New Roman', serif;"><span style="font-size: large;">Verweigern potentieller Mieter bzw. Sozialhilfeträger entsprechende Mitwirkungsmaßnahmen, sollte sich der Vermieter bewusst sein, dass er ein rechtliches Risiko eingeht.</span></span></p>
